Welcome to anmly.ai. By accessing or using our AI-powered data analytics platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and anmly.ai ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

anmly.ai provides an AI-powered data analytics platform that enables users to:

• Upload and store datasets (CSV, Excel files)
• Automatically train machine learning models
• Generate predictions and insights
• Access AI-powered explanations and chat assistance
• Organize projects and analyses
• Receive actionable business recommendations

The Service is provided on a subscription basis with various pricing tiers offering different features and usage limits.

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must create an account by providing accurate and complete information, including a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

• You are solely responsible for all activities under your account
• You must notify us immediately of any unauthorized access or security breach
• We recommend enabling multi-factor authentication (MFA) for enhanced security
• You must not share your account credentials with others

3.3 Age Requirements

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement.

3.4 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our sole discretion.

4. Acceptable Use Policy

4.1 Permitted Uses

You may use the Service for:

• Personal learning and experimentation with machine learning
• Research and development purposes
• Educational and academic projects

4.2 Prohibited Uses

You agree NOT to:

• Upload datasets containing illegal content or data obtained unlawfully
• Upload sensitive personal data without proper authorization (e.g., medical records, financial data, passwords)
• Use the Service to create models for discriminatory, harmful, or unethical purposes
• Attempt to reverse engineer, decompile, or extract the source code of our platform
• Interfere with or disrupt the Service or servers
• Access or attempt to access other users' data or accounts
• Use automated tools to scrape or harvest data from the Service
• Resell, redistribute, or sublicense access to the Service
• Use the Service to build a competing product or service
• Violate any applicable laws, regulations, or third-party rights
• Upload malicious code, viruses, or harmful content

4.3 Data Quality and Accuracy

You are responsible for the quality, accuracy, and legality of the data you upload. We do not verify or validate the content of your datasets. You represent that you have all necessary rights and permissions to upload and process your data through our Service.

5. Subscriptions and Payments

5.1 Pricing Plans

anmly.ai offers multiple subscription tiers:

• Free Plan: Limited AI credits and features
• Starter Plan: Monthly subscription with increased credits and features
• Professional Plan: Higher credit limits and advanced features

Current pricing is available on our website. We reserve the right to change pricing with at least 30 days' notice to existing subscribers.

5.2 Billing and Payments

• Subscriptions are billed monthly or annually depending on your selection
• Payments are processed securely through Stripe
• You authorize us to charge your payment method on a recurring basis
• All fees are non-refundable except as required by law
• You are responsible for providing accurate billing information

5.3 AI Credits

Our Service uses an AI credit system:

• Credits are consumed for ML training, predictions, AI explanations, and chat
• Credit costs vary based on the complexity of operations
• Credits reset monthly based on your plan
• Unused credits do not roll over to the next month
• Additional credits may be purchased as needed (if available)

5.4 Subscription Cancellation

• You may cancel your plan at any time through your account settings or Stripe billing portal
• Cancellations take effect at the end of the current billing period
• After cancellation, your account reverts to the Free plan
• No refunds are provided for partial months
• You retain access to your data after cancellation

5.5 Failed Payments

If a payment fails, we will attempt to charge your payment method again. If payment cannot be collected after multiple attempts, your plan may be downgraded to the Free plan, and access to premium features will be restricted.

6. Intellectual Property Rights

6.1 Your Data

You retain all ownership rights to the data you upload to the Service. By uploading data, you grant us a limited license to:

• Store and process your data to provide the Service
• Train machine learning models on your data for your use
• Generate predictions and insights based on your data
• Use OpenAI GPT models (via the OpenAI API) to provide explanations and chat features

We do not use your data to train our own models or share it with other users. Your data remains private and confidential subject to our Privacy Policy.

6.2 Generated Models and Results

Machine learning models trained on your data, along with predictions and insights generated by those models, are considered your property. You may download, use, and deploy these models as you see fit, subject to these Terms.

6.3 Platform Intellectual Property

The Service, including its software, algorithms, user interface, design, and documentation, is owned by anmly.ai and protected by intellectual property laws. You may not:

• Copy, modify, or create derivative works of the platform
• Reverse engineer or attempt to extract source code
• Remove or modify any proprietary notices
• Use our branding, logos, or trademarks without permission

6.4 Feedback and Suggestions

If you provide feedback, suggestions, or ideas about the Service, we may use them without any obligation to compensate you or provide attribution.

7. Data Privacy and Security

7.1 Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

7.2 Security Measures

We implement industry-standard security measures to protect your data, including:

• Encryption in transit (HTTPS/TLS) and at rest
• Row Level Security (RLS) in our database
• Secure authentication with JWT tokens
• Multi-factor authentication (MFA) option

The Service uses third-party providers (Supabase, OpenAI, Stripe, Railway.app, Vercel) to deliver functionality. These providers have their own terms and privacy policies. By using the Service, you agree to the terms of these third-party services.

8. Service Availability and Modifications

8.1 Service Availability

We strive to provide reliable service but do not guarantee that the Service will be:

• Available at all times without interruption
• Free from errors, bugs, or technical issues
• Compatible with all devices or browsers
• Maintained indefinitely without changes

8.2 Scheduled Maintenance

We may perform scheduled maintenance that temporarily interrupts service. We will attempt to provide advance notice when possible.

8.3 Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any feature of the Service
• Change system requirements or supported file formats
• Update our machine learning algorithms and models
• Adjust credit costs and pricing structures

We will provide reasonable notice of material changes when feasible.

8.4 Service Termination

We reserve the right to terminate or suspend the Service entirely at any time, with or without notice. In the event of permanent termination, we will provide at least 30 days' notice and an opportunity to export your data.

9. Limitations of Liability

9.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Accuracy of Results

While we strive for accuracy, we do not guarantee that:

• Machine learning models will be accurate or reliable
• Predictions will be correct or suitable for your purposes
• AI-generated explanations will be complete or error-free
• Insights will lead to successful business outcomes

You are responsible for validating results and using appropriate judgment before acting on any predictions or insights.

9.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANMLY.AI SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Costs of substitute services or procurement
• Damages arising from your use or inability to use the Service

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

9.4 User Responsibility

You acknowledge that:

• You use the Service at your own risk
• You are responsible for decisions based on Service outputs
• You should independently verify critical predictions or insights
• You must comply with all applicable laws when using the Service

10. Indemnification

You agree to indemnify, defend, and hold harmless anmly.ai, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• The data you upload or process through the Service
• Your use of outputs generated by the Service

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles.

11.2 Dispute Resolution Process

Before initiating formal legal proceedings, you agree to:

1. Contact us at info@delta-ai.nl to attempt to resolve the dispute informally
2. Provide a detailed description of the dispute and your desired resolution
3. Allow 30 days for good-faith negotiations

11.3 Arbitration (Optional)

If informal resolution fails, disputes may be resolved through binding arbitration in Amsterdam, Netherlands, rather than in court, except where prohibited by law. Each party will bear their own costs.

11.4 Exceptions

Either party may seek injunctive relief in court to prevent immediate harm or infringement of intellectual property rights.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and anmly.ai regarding the Service and supersede any prior agreements.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

12.5 Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or technical failures.

12.6 Survival

Provisions that by their nature should survive termination (including intellectual property rights, limitations of liability, and dispute resolution) shall survive termination of these Terms.

12.7 Language

These Terms are provided in English. In case of any translation, the English version shall prevail.

• We will notify you via email or through the platform for material changes
• Your continued use of the Service after changes constitutes acceptance
